1. TERMS AND CONDITIONS
These Terms & Conditions (“Terms”) govern your access to and use of the Educator Intelligence platform, including online courses, webinars, content, resources live events, and community features made available through it (“Platform”)
The Platform operated is by Class Cover Pty Ltd (ACN 153 495 268) (“ClassCover”, “we”, “us” or “our”). Users of the Platform interact contractually with ClassCover Pty Ltd.
By registering for an account, making a purchase, or accessing any content on the Platform, you agree to be bound by these Terms. If you are accessing the Platform on behalf of a school or organisation, you represent and warrant that you have authority to bind that organisation to these Terms, and references to "you" include that organisation.
If you do not agree to these Terms, you must not use the Platform.
2. ABOUT EDUCATOR INTELLIGENCE
Educator Intelligence is an online professional learning academy focused on artificial intelligence in education. It provides structured training and resources designed to help educators and schools safely and effectively adopt AI in teaching, learning, and school operations.
Educator Intelligence operates as a standalone online learning platform, separate from but supported by the ClassCover ecosystem. It does not require a ClassCover account to access. Users register directly with Educator Intelligence, and user accounts are managed separately from the ClassCover user system. However, the Platform is operated by ClassCover and user data will be accessed and used by ClassCover for marketing, operational, support, and service delivery purposes.
Content is delivered primarily as self-paced online learning and includes short video lessons, knowledge checks or reflection activities, practical demonstrations and examples, downloadable resources and templates, and certificates issued upon completion.
3. WHO MAY USE THE PLATFORM
(a) Eligibility
The Platform is intended for educators, school leaders, education professionals, and organisations purchasing professional learning for staff. From a usage perspective, each licence or subscription is associated with one profile per user.
You must be at least 18 years of age to register for an account and make a purchase. By registering, you confirm that you meet this requirement.
(b) Account Registration
To register, you will be asked to provide the following information: first name, last name, role type (e.g. casual teacher, classroom teacher, school leader), school name, and state in Australia. You must ensure that all information you provide is accurate, current, and complete. You must update your account information if it changes.
(c) Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately at [support email] if you suspect any unauthorised use of your account. We are not liable for any loss or damage arising from your failure to maintain the security of your account.
(d) One Account Per User
Each account is for a single individual user. You must not share your login credentials with any other person or allow any other person to access the Platform using your account. This applies to both individual subscribers and staff members accessing the Platform under a school licence.
4. ACCESS MODELS AND PRICING
Educator Intelligence provides access to its professional learning content through two main access models: school licences and individual subscriptions. In both cases, users are granted access to the Educator Intelligence course library, including courses and related resources made available during the relevant access period. The Platform does not operate on a pay-per-course purchase model.
(a) Individual Subscriptions
(i) Individual educators may access Educator Intelligence through a subscription purchased directly through the Platform. An individual subscription provides access for one user to the Educator Intelligence content library during the subscription term, including access to new courses, resources, and other content published during that period, and certificates of completion for relevant professional learning activities.
(ii) Individual subscriptions are subscription-based with automatic renewal. The subscription period, pricing, and billing frequency applicable to your subscription will be specified at the time of purchase. Current pricing is displayed on the Platform at the point of purchase.
(iii) Auto-Renewal: Your subscription will automatically renew at the end of each billing period at the then-current subscription price unless you cancel before the renewal date in accordance with clause 5 of these Terms. By purchasing a subscription, you authorise ClassCover (or its payment processor) to charge your nominated payment method on a recurring basis.
(iv) We will provide you with reasonable notice before your subscription renews, including the amount that will be charged. You are responsible for ensuring your payment details are kept up to date.
(b) School Licences
(i) Schools and education organisations can purchase an annual licence that provides access to Educator Intelligence for their staff directly through the Platform, with seats managed directly through the Platform. A school licence provides access for authorised staff members within the purchasing organisation, access to the Educator Intelligence content library during the licence term, access to new courses, resources, and other content published during that period, and certificates of completion for relevant professional learning activities.
(ii) School administrators purchase licences in blocks of 10, starting at a minimum of 10 seats, and invite staff members to create accounts under the organisation's licence.
(iii) School licences are purchased as an annual one-off payment with no automatic renewal. Schools must repurchase a licence to continue access after the annual period expires.
(iv) When a school licence expires, access for all staff members under that licence will cease. It is the school administrator's responsibility to manage licence renewals ahead of the expiry date.
(v) There is also the possibility for Educator Intelligence to be bundled with other ClassCover products as part of marketing initiatives. Where bundled access is provided, the terms applicable to that bundle will be communicated to you at the time of purchase.
(c) Content Library
The content library is updated and added to periodically throughout the year. We do not guarantee that any specific course, resource, or content item will remain available throughout your subscription or licence period. We reserve the right to update, modify, or remove content from the Platform at any time, subject to our obligation to provide you with access to a substantive content library during your access period.
5. PAYMENT AND BILLING
(a) Payment Processing
Payments will be processed through a third-party payment provider (including Stripe). Prices will be listed on the Platform at the point of purchase.
Payment information will be processed through secure third-party payment processors rather than stored directly by the Platform.
(b) Taxes
All prices are quoted in Australian dollars and are inclusive of GST where applicable, unless otherwise stated. You are responsible for any other taxes, duties, or levies that may apply in your jurisdiction.
(c) Failed Payments
If a payment fails, we may suspend your access to the Platform until payment is successfully processed. We may retry a failed payment and will notify you if your payment cannot be processed.
(d) Price Changes
We reserve the right to change the price of subscriptions or licences at any time. For individual subscribers, any price change will take effect from your next renewal period. We will give you reasonable prior notice of any price change. If you do not agree to the new price, you may cancel your subscription before the renewal date.
6. CANCELLATION AND SUSPENSION OF ACCESS
(a) Cancellation by Individual Subscribers
(i) Users may cancel their subscription at any time. Cancellation stops future billing but does not entitle you to a refund for the current billing period. Your access to the Platform will continue until the end of the current billing period, after which your account will revert to a deactivated status.
(ii) To cancel your subscription, you may do so through your account settings or by contacting us at support@classcover.com.au.
(b) Cancellation by Schools
School licences are annual and non-renewing. A school may choose not to renew its licence by simply not repurchasing at the end of the licence period. There is no formal cancellation process required for school licences, as access will automatically cease at the end of the licence term.
(c) Suspension or Termination by ClassCover
We may suspend or terminate your access to the Platform, or remove your account, at any time and without prior notice if we reasonably believe that:
(i) you have breached these Terms;
(ii) your use of the Platform is causing harm or risk to ClassCover, other users, or third parties;
(iii) you have provided false or misleading information in connection with your account; or
(iv) we are required to do so by law.
If we suspend or terminate your access for breach of these Terms, you will not be entitled to a refund of any fees paid.
7. REFUND POLICY
(a) School Licences
(d) How to Request a Refund
School licences are organisational purchases and are treated as business-to-business transactions. Refunds are available within 14 days of purchase only if the licence has not been activated. A licence is considered activated if staff accounts have been created or platform content has been accessed. Once activated, the licence becomes non-refundable. No partial refunds are available for unused time during the licence period. This protects against situations where a school activates multiple users and later requests a refund.
(b) Individual Subscriptions
Individual users access the Platform through a subscription that renews automatically. Refunds are available within 7 days of an initial purchase if minimal platform content has been accessed. For subscription renewals, refunds are only available if requested within 48 hours of the renewal charge. Refunds are not provided for partially used billing periods.
(c) Exceptional Circumstances
Refunds outside the standard policy may be granted at the discretion of ClassCover in exceptional circumstances, such as duplicate purchases, billing errors, or technical issues preventing access to the Platform. Any request for a discretionary refund must be submitted to support@classcover.com.au with details of the relevant circumstances.
(d) How to Request a Refund
All refund requests must be submitted in writing to [support email]. We will assess your request and respond within a reasonable time. Approved refunds will be credited back to your original payment method.
(e) Australian Consumer Law
Nothing in this refund policy limits or excludes any rights or guarantees you may have under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)) ("ACL") that cannot be excluded. If you are a "consumer" as defined under the ACL and a statutory consumer guarantee applies to your purchase, we will provide any remedy required by law.
8. INTELLECTUAL PROPERTY
(a) Ownership
(i) All course materials are owned or licensed by ClassCover (trading as Educator Intelligence). This includes videos, course frameworks, templates, downloadable resources, presentations, and assessment examples.
(ii) All intellectual property rights in the Platform, its content, and its design (including copyright, trade marks, and any other rights) are owned by or licensed to ClassCover. "Educator Intelligence" is a brand owned by ClassCover Pty Ltd.
(b) Licence to Users
Users are granted access to the materials for their own professional learning. This constitutes a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform content for your own personal, non-commercial professional development purposes during your active subscription or licence period only.
(c) Prohibited Uses
Users must not reproduce, redistribute, sell, or publicly share course materials without permission. Accordingly, you acknowledge and agree that you must not use the Platform to:
(i) upload, post, or otherwise transmit any content that is unlawful, harmful, threatening, abusive, harassing, tortuous, defamatory, vulgar, obscene, libellous, invasive of another’s privacy, hateful, or racially, ethnically or otherwise objectionable;
(ii) forge headers or otherwise manipulate identifiers in order to disguise the origin of any content transmitted through Platform;
(iii) upload, post, or otherwise transmit any content that you do not have a right to transmit under any law or under contractual or fiduciary relationships (such as inside information, proprietary and confidential information learned or disclosed as part of employment relationships or under nondisclosure agreements);
(iv) upload, post or otherwise transmit any Content that infringes any, trademark, copyright or other proprietary rights of any party;
(v) upload, post or otherwise transmit any unsolicited or unauthorised advertising, promotional materials, “junk mail”, “spam”, “chain letters”, “pyramid schemes”, or any other form of solicitation;
(vi) upload, post, or otherwise transmit any material that contains software viruses or any other computer code, files or programs designed to interrupt, damage, destroy or limit the functionality of any computer software or hardware or telecommunications equipment;
(vii) interfere with or disrupt Platform or servers or networks connected to Platform, or disobey any requirements, procedures, policies or regulations of networks connected to Platform;
(viii) intentionally or unintentionally violate any applicable law or regulation including, but not limited to, regulations promulgated by any securities exchange.
(d) Your Use Globally
Recognising the global nature of the internet, you agree to comply with all local laws and rules regarding online conduct and acceptable Content. Specifically, you agree to comply with all applicable laws regarding the transmission of data in Australia.
(e) User-Generated Content
Where the Platform includes community forums, discussion boards, or other interactive features, you may submit content including posts, comments, and uploaded files ("User Content"). By submitting User Content, you:
(i) confirm that you own or have all necessary rights to the User Content you submit;
(ii) grant ClassCover a non-exclusive, royalty-free, worldwide, perpetual licence to use, display, reproduce, moderate, and remove that User Content for the purposes of operating the Platform; and
(iii) confirm that your User Content does not infringe the rights of any third party.
ClassCover does not endorse, and is not responsible for, User Content posted by other users. We reserve the right to remove any User Content that, in our reasonable opinion, violates these Terms or is otherwise inappropriate.
9. ACCEPTABLE USE
(a) Conduct Requirements
Users must follow basic conduct guidelines, including respectful participation, no harassment or discrimination, no sharing of confidential student data, and no unauthorised commercial promotion.
(b) Prohibited Conduct
You must not use the Platform to:
(i) engage in any unlawful, harassing, defamatory, discriminatory, or abusive conduct;
(ii) share, upload, or post any content that is offensive, harmful, or in violation of any applicable law;
(iii) share any confidential information relating to students, including student personal information;
(iv) promote or advertise your own or any third party's products or services without ClassCover's prior written consent;
(v) attempt to gain unauthorised access to any part of the Platform or any other user's account;
(vi) use automated tools, bots, or scripts to access, scrape, or extract content from the Platform; or
(vii) interfere with or disrupt the integrity or performance of the Platform.
User inputs in the Platform are limited to course interaction. Whilst the Platform may include community comment or discussion features, users should not input student personal information into any part of the Platform.
(c) Consequences of Misuse
ClassCover may suspend accounts for misuse. If we suspend or terminate your account for breach of this clause, you will not be entitled to a refund of any fees paid.
10. AI CONTENT DISCLAIMER
(a) Educational Purpose
(i) The Platform provides educational guidance about AI in education. Content may include demonstrations of AI tools or workflows.
(ii) All content is informational only. Nothing on the Platform constitutes legal, compliance, regulatory, or professional advice.
(b) No Reliance
(i) AI tools and practices may change over time. Schools must follow their own policies. The academy does not provide legal or compliance advice. Users remain responsible for how they apply AI tools in their schools.
(ii) Before implementing any AI tool, practice, or workflow in your school or educational setting, you should:
(A) consult your school's own policies and guidelines on AI use;
(B) seek independent professional or legal advice where appropriate; and
(C) exercise your own independent professional judgement.
(c) No Guarantee of Currency
The Platform's content reflects information available at the time of publication. The AI landscape evolves rapidly, and ClassCover does not warrant that any content relating to specific AI tools, platforms, or policies is current, complete, or applicable to your specific circumstances.
(d) School Administrator Responsibility
Where a school purchases a licence and makes the Platform available to its staff, the school administrator is responsible for ensuring that staff participation in Platform courses is consistent with the school's own AI governance policies.
11. THIRD-PARTY SERVICES
(a) Third-Party Platforms

The Platform relies on several external services, which may include LearnWorlds (the learning platform), Stripe (payments), webinar platforms, email marketing platforms, and analytics services.
(b) No Endorsement
The inclusion of any third-party service on the Platform does not constitute an endorsement by ClassCover of that service. ClassCover is not responsible for the availability, accuracy, or performance of any third-party service.
(c) Third-Party Terms
Your use of third-party services integrated with the Platform may be subject to those providers' own terms and conditions and privacy policies. We encourage you to review the terms of any third-party service you interact with through the Platform.
12. CERTIFICATIONS AND PROFESSIONAL LEARNING RECOGNITION
(a) Nature of Certificates
Courses may issue certificates of completion. These certificates indicate that a user has completed the course content but do not represent formal accreditation or a regulated qualification.
(b) School Recognition
Schools may choose to count course completion towards professional learning requirements, but this is determined by each system or jurisdiction. ClassCover makes no representation that any course satisfies mandatory professional learning requirements in any state or territory.
13. SCHOOL ADMINISTRATOR OBLIGATIONS
Where you purchase a school licence or administer access for staff members, you agree to the following obligations:
(a) you have authority to bind your school or organisation to these Terms;
(b) you will only invite staff members who are authorised to access the Platform on behalf of your organisation;
(c) you will ensure that all staff members invited to create accounts under your licence are made aware of and agree to these Terms before accessing the Platform;
(d) you will ensure, to the best of your ability, that all necessary consents and authorisations are in place within your organisation in connection with the use of the Platform;
(e) you will promptly deactivate or notify ClassCover of any staff member who is no longer authorised to access the Platform (e.g. upon cessation of employment); and
(f) you are responsible for the conduct of all staff members accessing the Platform under your licence.
14. DISCLAIMER OF WARRANTIES
(a) Platform Availability
We will use reasonable endeavours to make the Platform available at all times, but we do not guarantee uninterrupted or error-free access. The Platform may be subject to scheduled maintenance, upgrades, or outages beyond our reasonable control.
(b) Content Accuracy
To the maximum extent permitted by law, all Platform content is provided "as is" and without warranties of any kind, either express or implied, including warranties of accuracy, fitness for a particular purpose, or non-infringement.
(c) No Professional Advice
Nothing on the Platform constitutes professional, legal, regulatory, or compliance advice. ClassCover is not responsible for any decisions made by users, schools, or organisations based on Platform content.
15. LIABILITY
(a) Exclusion of Certain Losses
To the maximum extent permitted by law, ClassCover excludes all liability for:
(i) any indirect, incidental, special, punitive, or consequential loss or damage;
(ii) loss of profits, revenue, data, goodwill, or opportunity;
(iii) any loss or damage arising from your reliance on Platform content, including content about AI tools or practices;
(iv) any loss or damage arising from the acts or omissions of third-party service providers; or
(v) any harm arising from decisions made by schools or educators based on course content.
(b) Liability Cap
To the maximum extent permitted by law, ClassCover's aggregate liability to you in connection with the Platform (whether in contract, tort, under statute, or otherwise) is limited to the total amount of fees paid by you to ClassCover in the 12 months preceding the event giving rise to the claim. Where you have not paid any fees (e.g. during a free trial period), ClassCover's liability is limited to AUD $100.
(c) Consumer Law Savings
Nothing in these Terms limits or excludes any liability that cannot be excluded by law, including any guarantees under the ACL. Where ClassCover's liability cannot be excluded but can be limited, ClassCover's liability is limited to, at ClassCover's election:
(i) in the case of goods: the replacement or repair of the goods or the supply of equivalent goods; and
(ii) in the case of services: the resupply of the services or the cost of having the services resupplied.
16. PRIVACY
Your privacy is important to us. The Platform is operated by ClassCover and user data will be accessed and used by ClassCover for marketing, operational, support, and service delivery purposes. Please review our Privacy Policy, which forms part of these Terms, for information about how we collect, use, store, and disclose your personal information.
17. GOVERNING LAW & DISPUTE RESOLUTION
(a) Governing law
These Terms are governed by the laws of New South Wales, Australia, and the parties submit to the exclusive jurisdiction of its courts.
(b) Dispute Resolution
If you have a dispute with us, please contact us first at support@classcover.com.au. We will endeavour to resolve any dispute informally within 14 days. If the dispute is not resolved informally, either party may refer the matter to mediation administered by the Australian Disputes Centre before commencing court proceedings.
18. GENERAL
(a) Entire Agreement
These Terms, together with the Privacy Policy and any other policies published on the Platform, constitute the entire agreement between you and ClassCover with respect to your use of the Platform and supersede all prior agreements or representations.
(b) Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
(c) Waiver
Any failure by ClassCover to enforce a provision of these Terms does not constitute a waiver of that provision.
(d) Assignment
You may not assign your rights or obligations under these Terms without ClassCover's prior written consent. ClassCover may assign its rights and obligations under these Terms to any related entity or successor in connection with a merger, acquisition, or sale of assets.
