1. INTRODUCTION
This Privacy Policy explains how we collect, use, disclose, and manage your personal information when you use the Educator Intelligence platform (“Platform”) operated by Class Cover Pty Ltd ACN 153 495 268 (referred to in this privacy policy as “ClassCover”, “we”, “us”, or “our”). The Platform operates as a standalone online learning platform, separate from but supported by the ClassCover ecosystem.
We are committed to protecting your personal information and handling it in a responsible manner in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (“APPs”).
If the General Data Protection Regulation (EU) 2016/679 (the “GDPR”) and the UK Data Protection Act 2018) is applicable to you and your personal information, your personal information (or personal data, as it’s referred to under the GDPR) will be controlled by us.
By providing personal information to us, you consent to our storage, maintenance, use and disclosing of personal information in accordance with this privacy policy.
We may change this privacy policy from time to time by posting an updated copy on our website and we encourage you to check our website regularly to ensure that you are aware of our most current privacy policy.
2. WHAT INFORMATION WE COLLECT
We may collect personal information including:
• name;
• email address;
• school or organisation;
• job role and role type;
• state or location within Australia;
• account and login information;
• course enrolment, progress and completion data;
• certificates issued;
• transaction data, including purchase records, payment confirmations and invoices; and
• communications, comments or forum participation (where applicable).
Payment information is processed by third party providers and is not stored directly by us.
3. HOW WE COLLECT INFORMATION
We may collect personal information either directly from you, or from third parties, including where you:
• contact us through the Platform;
• receive goods or services from us;
• submit any of our online sign up forms;
• communicate with us via email, telephone, SMS, social applications (such as LinkedIn, Facebook or Twitter) or otherwise;
• interact with our website, social applications, services, content and advertising; and
• invest in our business or enquire as to a potential purchase in our business.
We may also collect personal information from you when you use or access our website or our social media pages. This may be done through use of web analytics tools, ‘cookies’ or other similar tracking technologies that allow us to track and analyse your website usage. Cookies are small files that store information on your computer, mobile phone or other device and enable and allow the creator of the cookie to identify when you visit different websites. If you do not wish information to be stored as a cookie, you can disable cookies in your web browser.

4. HOW WE USE PERSONAL INFORMATION
We use personal information to:
• provide and administer the Platform;
• process payments and issue invoices;
• issue certificates of completion;
• to provide goods, services or information to you;
• to manage accounts, licences and subscriptions (and other record keeping and administrative purposes);
• to provide information about you to our contractors, employees, consultants, agents or other third parties for the purpose of providing goods or services to you;
• to improve and optimise our service offering and customer experience;
• to comply with our legal obligations, resolve disputes or enforce our agreements with third parties;
• to send you marketing and promotional messages and other information that may be of interest to you and for the purpose of direct marketing (in accordance with the Spam Act). In this regard, we may use email, SMS, social media or mail to send you direct marketing communications. You can opt out of receiving marketing materials from us by using the opt-out facility provided (e.g. an unsubscribe link); and
• to send you administrative messages, reminders, notices, updates, security alerts, and other information requested by you.
5. DISCLOSURE OF INFORMATION
We may disclose your personal information to:
(a) Related Entities: Educator Intelligence is a standalone product with no SSO to ClassCover to access. The platforms sit as separate databases, but data is owned by ClassCover. Personal information collected through the Educator Intelligence Platform may be accessed by ClassCover for the purposes described in clause 4 of this Policy.
(b) Third-Party Service Providers: We disclose personal information to third-party service providers who assist us in operating the Platform. These include:
(i) LearnWorlds — our learning management system, which hosts the Platform and processes usage and account data on our behalf.
(ii) Stripe — our payment processor, which processes payment card information in connection with purchases made on the Platform.
(iii) Email marketing platforms — we use email marketing services to send you communications about the Platform and other ClassCover products.
(iv) Analytics providers — we may use Google Analytics and other analytics tools to understand how users interact with the Platform.
(v) Webinar platforms — we use third-party webinar platforms to host live events.
(c) Overseas Disclosure
(i) LearnWorlds is hosted in the United States of America. By using the Platform, you consent to the disclosure of your personal information to LearnWorlds in the United States for the purpose of hosting and operating the Platform.
(ii) We may also disclose your personal information to other overseas recipients in connection with the use of analytics or email marketing platforms. Where we do so, we take reasonable steps to ensure that those recipients handle your personal information in a manner consistent with the APPs.
(iii) Please be aware that overseas recipients may be subject to the laws of their country of domicile, which may not provide the same level of protection as Australian privacy law.
(d) Legal Requirements
We may disclose your personal information if required to do so by law, or if we reasonably believe that disclosure is necessary to protect the rights, property, or safety of ClassCover, our users, or the public.
6. DATA RETENTION
(a) We retain your personal information for as long as your account is active or as necessary to provide you with access to the Platform and fulfil the purposes described in this Policy. We will also retain personal information as required to comply with our legal obligations, resolve disputes, and enforce our agreements.
(b) If you close your account or your access to the Platform ceases, we may retain certain personal information (such as transaction records and certificates issued) for a period of time as required by law or legitimate business purposes.
(c) You may request deletion of your personal information as set out in clause 11(b) of this Policy.
7. STUDENT DATA
(a) The Platform requires that users must not share confidential student data through the Platform. The Platform is designed for educators and education professionals and is not intended to be used to store, process, or transmit student personal information.
(b) While the Platform may include community comment or discussion features, users should not input student personal information into any part of the Platform.
(c) Where a school purchases a licence and provides access to staff, the school is responsible for ensuring that its staff do not enter student personal information into the Platform.
(d) ClassCover accepts no responsibility for any student personal information entered into the Platform by users in contravention of these requirements.
8. CHILDREN
The Platform is not intended for use by persons under the age of 18. We do not knowingly collect personal information from minors. If you believe that we have inadvertently collected personal information from a minor, please contact us at support@classcover.com.au and we will take steps to delete that information.
9. LINKS TO THIRD-PARTY WEBSITES
The Platform may contain links to third-party websites or services. This Privacy Policy does not apply to those third-party sites. We encourage you to review the privacy policies of any third-party sites you visit.
10. COOKIES AND ANALYTICS
(a) The Platform may use cookies and similar tracking technologies to enhance your experience, analyse usage, and support marketing activities.
(b) Cookies are small data files stored on your device. We use:
(i) Essential cookies: necessary for the Platform to function, including maintaining your login session;
(ii) Analytics cookies: used to understand how users interact with the Platform (e.g. via Google Analytics); and
(iii) Marketing cookies: used to deliver relevant marketing communications.
(c) You may control the use of cookies through your browser settings. Disabling certain cookies may affect the functionality of the Platform.
(d) By continuing to use the Platform, you consent to our use of cookies in accordance with this Policy.
11. YOUR RIGHTS TO ACCESS AND DELETE YOUR DATA
(a) Access and correction
If you wish to request access to the personal information we hold about you, please contact us at [privacy@classcover.com.au]. We may need to verify your identity before providing you with your personal information. In some cases, we may be unable to provide you with access to all your personal information and where this occurs, we will explain why. We will respond to your request for access to personal information within a reasonable timeframe (and in any event within 30 days).
If you think that any personal information we hold about you is inaccurate, please contact us using the contact details set out below and we will take reasonable steps to ensure that it is corrected.
(b) Deletion Requests
You may request that we delete your personal information by contacting us at support@classcover.com.au. We will consider your request and respond within a reasonable time. Please note that we may be unable to delete certain information where we are required to retain it by law or for legitimate business purposes (such as transaction records).
(c) Opting Out of Marketing
You may opt out of receiving marketing communications from us at any time by using the unsubscribe link in any marketing email or by contacting us at support@classcover.com.au.
12. SECURITY
We take reasonable steps to ensure your personal information is secure and protected from misuse or unauthorised access. Our information technology systems are password protected, and we use a range of administrative and technical measures to protect these systems.
13. CHANGES TO THIS PRIVACY POLICY
(a) We may update this Privacy Policy from time to time to reflect changes in our practices, technology, or legal obligations. If we make material changes, we will notify you by email or by posting a notice on the Platform prior to the changes taking effect.
(b) The updated Privacy Policy will be effective from the date it is posted on the Platform. Your continued use of the Platform after that date constitutes your acceptance of the updated Policy.
14. COMPLAINTS
(a) If you believe that we have breached the APPs or otherwise mishandled your personal information, please contact our Privacy Officer at support@classcover.com.au. We will endeavour to investigate and respond to your complaint within 30 days.
(b) If you are not satisfied with our response, you may lodge a complaint with the Office of the Australian Information Commissioner (OAIC) at www.oaic.gov.au or by calling 1300 363 992.
